Can you maybe make a post about the DMCA and how it applies to those living in the U.S. I submitted a NOI before and didn’t have to prove that my work was copyrighted (registered), so I’m really confused about this whole thing…

Well, I recently ran into an issue with trademarks in a domain name. At first I was a little annoyed, but then I realized that what I had done was wrong and took my site down. I realized that by including the trademark name in the domain that I was sending a message to the public that I was affiliated with that company and I really wasn't. Lesson learned.

@troy Part 2 is here: http://myows.com/blog/copyright-basics-part-2/

@Crawl Space Yeah, trademark and copyright do overlap but are very different areas of law. In a tiny nutshell, copyrights are recognized globally and reward creativity, whereas trademarks are territorial, by sector of activity and protect businesses and consumers against being fooled into buying a product from Company Y when in fact they thought they were buying from Company X.

I do recommend you go to the USPTO's website and fill in a TM form even if it's fictitious and you abandon the process before signing and paying. It was a great experience for me.

DISCLAIMER: I'm a designer, not a lawyer!

Very good info on copyrights. I'd also like to read more information on trademarks as wells and the legality around that.
